Repeat Drunk Driver Sentenced in Rock County

 

NEWS RELEASE: Janesville, WI - Rock County District Attorney David O'Leary announced that Paul G. Barber Jr., age 52, was sentenced today by the Honorable James P. Daley for the offense of operating a motor vehicle while intoxicated as a 10th offense in Circuit Court Case 2012CF1207. During sentencing, Assistant District Attorney Jodi Dabson Bollendorf emphasized that Barber had previously been arrested 21 times for the offense of operating while intoxicated in multiple states dating back to 1982; however, in Wisconsin, prior convictions occurring prior to 1989 are not counted under the law.  Both the Department of Corrections and ADA Dabson Bollendorf argued for the maximum sentence of 7.5 years confinement followed by 5 years of extended supervision. Judge Daley sentenced Barber to less than the maximum and ordered 6 years of confinement followed by 5 years of extended supervision.

The facts of the case as set forth by the criminal complaint are that on May 25, 2012, State Trooper Bauer located Barber in his vehicle parked on the shoulder of I39/I90 and observed that Barber's vehicle had fresh damage on the left side. Barber initially stated that he had rolled his vehicle, then changed his story and could not remember what happened. Trooper Bauer could smell an odor of intoxicants coming from Barber's breath and began field sobriety tests until Barber refused to complete any more tests and stated "I'm done with this."  Barber's blood was tested and the results showed a blood ethanol level of .296.

Pursuant to the directive of the Wisconsin Supreme Court, as found in Supreme Court Rule 20:3.6, Trial Publicity, you are advised that a charge is merely an accusation and that a defendant is presumed innocent until and unless proven guilty.

A Rock County judge sentenced Barber to six years in prison, with five years of extended supervision. Since 1982, Barber has been arrested 21 times for driving drunk, with the last time being on May 25, when he had a blood alcohol level of .296.
