UPDATE: A jury has found Marco Hernandez, 20, guilty of first degree murder. He's accused of murdering a man at a Belvidere gas station in April 2013.
Hernandez is facing 45 years to life in prison. He will be sentenced September 17th.
The victim's family says they are thankful for the guilty verdict. The defense says they will likely appeal.
A jury is deliberating right now to decide if 20-year-old Marco Hernandez is guilty of murder. Hernandez is accused of shooting and killing 33-year-old Richard Herman at a Belvidere gas station in April 2013. Officers say the two men along with another suspect, Deonte Murray were all arguing when Hernandez shot Herman.
However, the defense argues Hernandez never touched the gun, claiming Murray fired the fatal shot. Police say Hernandez and Murray are suspected gang members.
BOONE COUNTY (WIFR) – Opening statements have begun in the gang-related murder trial of a 19-year-old in Boone County.
Belvidere man Marco Hernandez is accused of first-degree murder in connection to the murder of a man at the Shell station in Belvidere on North State Street back in April 2013. Hernandez is a known gang member to police.
BELVIDERE (WIFR) -- Both of the men wanted in connection with the Belvidere murder at the Shell gas station are in custody tonight.
Officers nabbed 19-year-old Marco Hernandez this morning. Apparently he was hiding out in a home on West Madison Street in Belvidere. When the police showed up, he tried to crawl out a window to escape, but officers had the place surrounded. His alleged partner in crime, 21-year-old Deontae Murray was caught last week.
They’re accused of gunning down 33-year-old Richard Herman at a Belvidere gas station.

On Tuesday, May 14,2013, the U.S. Marshals Apprehension Unit and Belvidere Police arrested the second subject wanted in connection to a Belvidere Gang Related Homicide.
Marco Hernandez, 19 years old and known gang member of Belvidere, was arrested for first degree murder. Hernandez remains in the Boone County Jail on a no bond.
On Tuesday, May 14, 2013, in the early morning hours, U.S. Marshals received information that Hernandez was in a residence located in the 600 block of West Madison Street, in Belvidere. The U.S. Marshals Apprehension unit, Belvidere Police, and a McHenry County Sheriff's K-9 Unit surrounded the residence. Officers approached the residence and made contact with the occupants. Hernandez was immediately taken into custody after he attempted to flee by crawling out a rear window of the residence.
UPDATE: ROCKFORD (WIFR) -- One of the men wanted in connection with Belvidere’s gas station murder has been captured.
21-year-old Deontae Murray was caught in the 900 Block of 11th Street in Rockford. He and Marco Hernandez are accused of shooting 33-year-old Richard Herman after an altercation at the Shell gas station on North State Street in Belvidere. Hernandez is still on the lam. Anyone with information is asked to call Crimestoppers.
BELVIDERE (WIFR) -- Two alleged murder suspects remain on the run, after a man is gunned down at a Belvidere Gas Station.
Police thought they were close to arresting one of the suspects Monday afternoon. SWAT teams, robots, and K-9 units were called to a home on 20th Street in Rockford. After reports that Deontae Murray, 21, may be inside. After nearly nine hours, it turns out the suspect had left the house before police arrived. Murray and another man Marco Hernandez, 19, are wanted for fatally shooting Richard Herman, 33, outside a North State Street gas station Sunday. The men are suspected gang members.
20th Street in Rockford is now back open after armed SWAT teams dressed in camouflage surrounded the home for nearly nine hours, relying on robots and K-9 units as their eyes and ears into the house’s basement.
What seemed like a reliable tip from a family member, turned out to be a bust. Police were told 21-year-old Deontae Murray, an alleged gang member and one of two suspects in Sunday’s fatal shooting was inside the home at around midnight, but after a thorough search, investigators say he must have run off before they arrived.
Murray and another man are accused of killing 33-year-old Richard Herman outside the Shell gas station on North State Street in Belvidere. Witnesses say the men got into an argument before the situation turned fatal.
Nashold Elementary School was put on lock-down during the search, meaning no one could come in or out of the building.
Police have not released the second suspect’s name, but say he goes by “King Wacko” on the streets.
UPDATE: Police say 21-year-old Deontae Murray was not inside the home in the 2800 block of 20th Street.
They've been on scene since 3:30 this morning.
Just a few minutes ago they used robots to thoroughly sweep the home. Murray was not located.
UPDATE: Nashold Elementary School is on soft lockdown while the standoff continues. That means classes will continue, but they aren't letting anyone in or out of the building at this time.
UPDATE -- Rockford Police closed the 2800 block of 20th Street early this morning due to an ongoing police investigation. Police confirm they are attempting to make contact with 21-year-old Deontae Murray, a murder suspect in a Belvidere shooting Sunday night.
Rockford and Belvidere police are at the 2800 block of 20th Street along with SWAT personnel but so far have not received any response from Murray to their requests. The home belongs to one of Murray's relatives and police received information that Murray is at this home.
Rockford Police recommend steering clear from the area.
UPDATE -- The Belvidere Police Department is looking for information on two suspects in a homicide on the city's north side Sunday night that it now says is gang-related.
Known gang member 21-year-old Deontae Murray is wanted for first degree murder. Belvidere police have obtained a no-bond warrant for his arrest.
On Sunday after 6:30 p.m., Belvidere police responded to the Shell gas station in the 1000 block of N. State Street. According to witnesses, four people got into an altercation in the parking lot. Police say one of the subjects pulled out a handgun and shot someone, then Murray and another man fled from the scene on foot.
33-year-old Richard Herman was shot in the chest. The Belvidere resident was transported to SwedishAmerican Hospital and was pronounced dead there.
Murray is described as a black man, over six feet tall, 200 pounds, with black hair and brown eyes. The other man is described as Hispanic, 5 and a half feet tall, 150 pounds, with black hair and goes by the street name, King Wacko.

UPDATE -- Police in Belvidere say a man in his 20's was shot to death outside the Shell Gas Station on N. State Street in Belvidere.
Police say they responded to a call around 6:30pm on Sunday. Shortly after they arrived, they found the victim suffering from gunshot wounds. He was rushed to SwedishAmerican Hospital. Investigators are talking to witnesses, who say they saw two suspects fleeing the scene on foot. The department has not yet released a description of the suspects. Police aren't sure if this incident was gang related.
BELVIDERE (WIFR)- Police are investigating a fatal shooting in Belvidere right now.
Investigators say it happened at the Shell Gas Station on North State.
