Contractor Forced to Pay Restitution

Fred and Donna Gummow can finally relax on their backyard porch. After three years of fighting to get a refund from contractor David K. Hall, the court rules in their favor. Hall got 17-hundred dollars upfront from the Gummows to build their dream porch and promised something really too good to be true.

Hall presented the Gummows with a brochure that shows a gorgeous sketch of what their screen porch and deck would like like. What they didn't know, that was the most work he'd ever do.

"He says if you want your money back, sue me," Gummow says.

Hall was charged with two counts of home repair fraud, both Gummow and another victim dropped those charges once given a 12-hundred and 3-thousand dollar refunds.

"The reason I dropped it is to have a more serious case against him," Gummow says.

The case Hall now faces is a class four felony for deceptive practices and Boone County is also charging him for home repair fraud. And more charges are on the way according to the Attorney General's office. This comes as no surprise to better Business Bureau Director Dennis Horton. He met with Hall to go over the 17 business complaints received.

"Of the complaints he had he had all copies of them he promised to respond to them and very honestly he hadn't done that it's not that he won't but he promised to do it in two days," Horton says.

That was three weeks ago. In the meantime, Hall is also taking legal action and is suing the Gummow's for breech of contract since someone else finished their porch and deck. And the Gummows are countersuing.

Hall is back in Winnebago County court on June 20th for deceptive practice. He faces one to three years in prison and up to a 25-thousand dollar fine. He also appears in Boone County on August sixth for a jury trial on home repair fraud. David Hall refused to comment.

    I am a deck builder and very proud of our companies workship and customer satisfaction. Contractors like this tarish the image of the entire industry.

    I too dealt with Mr. Hall in 2003. I gave him about $1,300 down and dealt with the same excuses you all have heard. Fortunately for me I work for the Sheriff's Office in Boone County and I called him day and night over a hundred times including from my place of work. I'm sure he was nervous when he saw the caller ID. I never threatened him but I think I scared him by who I work for. I even went to his house but I did get a check. It took six months however. He even threatened me with lawsuit because I had my deck done by someone else. If anyone wishes to speak to me regarding my dealings with Mr. Hall, please e-mail me. I will love to see this crook in the clink.

    David Hall also swindled us. Contracted to install sliding shelves in kitchen cabinets in April 2006 at an initial payment of $600, he never did anything. In spite of Sheriff and BBB complaints on our part, our money has never been refunded. He is as crooked as can be. We were told to sue him in small claims, but we didn't want the hassle & just dropped the matter. We are pleasantly surprised to see him get his justice.

    Hall was paid 1800 (1/3 down) by us for a deck, it never happened, he had every excuse in the book. After reporting him to the BBB, he called and promised to refund us, we have yet to see any refund.

    I am yet another person, along with my sister who has been "taken" by David Hall. I have filed a complaint with the BBB and a police report with Winnebago County. I would love to know what else to do to think we might get our money back too. Detective Berg was going to be in contact with me last month (before Hall went to court) With all of these charges pending, I was absolutely appalled to see him at this past home show.

    I am so elated to hear this story and contractor is being exposed. I guess there is still hope to get some action on a contractor that has not only duped the public but HUD and the federal government. I think many of us are afraid of is that we are poor and, you know only to well, the small fries in a skillet of fish are the last ones noticed and eaten. I am one of many, many homeowners in the "Hope 6" project and now I understand there are some in the "Westend Revitalization" that are disgusted with their contractors. I wonder if both have the same contractors.
