Opening Statements Underway in Nichols Trial

Despite a problem with the jury, the state murder trial of Oklahoma City bombing conspirator Terry Nichols is proceeding.

The judge Monday dismissed two jurors and an alternate because they're distant cousins of an attorney in the local prosecutor's office. The attorney isn't directly involved in the Nichols trial.

The shake-up means the trial now has fewer alternates than the judge had initially wanted to use. Opening statements are underway.

Prosecutors learned of the problem on March 9, but didn't tell the judge about it until after the jury was already seated.

The judge is criticizing prosecutors for what he calls "inexcusable conduct." No word on why prosecutors didn't speak up sooner.
