POPLAR GROVE (WIFR) -- Developer Flora Meadows claims it was denied due process when applying for a special use permit in the company's attempt to build a mobile home community in Poplar Grove.
Flora filed a lawsuit on June 5th in Boone County stating Poplar Grove Village trustees were acting arbitrarily and capriciously when denying the developer a special use permit to build a nearly 285 unit mobile home park on Poplar Grove Road.
We reached out to village leaders Sunday afternoon but didn't hear back as of 10pm.
Some residents say they are disappointed Flora isn't accepting the village board's decision which was one many home owners agree with.
Those same home owners were not happy with Flora's plan from the moment it was announced and introduced to the public.
Tom Nicholl's home sits on Poplar Grove Road and would have been surrounded by the development. He says ever since the vote in early March he had a feeling Flora wasn't done with their efforts to build the mobile home park.
"It's like a train and you're on the tracks," said Nicholl about Flora's persistence in this matter. "If you don't move you're going to get run down."
Home owners feel the village may not be in a position financially to endure a long legal dispute, although we weren't able to confirm that with village leaders.
A hearing is scheduled for December 10th at the end of this year.
