ROCKFORD (WIFR) -- The Rockford Police officer involved in the deadly shooting of Mark Barmore in 2009 will have to wait even longer before hitting the streets as a Rockford cop.
Court documents show the City of Rockford filed an appeal to an arbitrators decision reinstating Oda Poole with the police department.
That ruling came down in November 2013 which put Poole back on the payroll.
He hasn't been working as an officer though.
He first has to complete a fitness for duty exam. But this latest appeal could hold up the process.
The city argues the arbitrators decision exceeded her authority under the collective bargaining agreement.
The union now has 30 days from Wednesday to file a response.
