An attorney for Jeremiah Johnson says he will file the lawsuit in federal court in Rockford Wednesday. Johnson is also scheduled to appear with Lieutenant Pat Quinn at a news conference in Chicago Wednesday.
Quinn says the village broke state and federal laws by not reinstating Johnson when he returned from duty. Johnson was fired from the police force in February 2003, 11 days after being activated for service in Iraq.
Village officials say Johnson was still on probation at the time of his firing and that he was missing work and coming in late.
