That was the conclusion published Friday in a three-page report from the Ogle County Sheriff's Office.

That report clears Officer James Jakymiw of any wrong-doing and says the deceased driver, 72-year-old David Becker of Rochelle, failed to yield to the emergency vehicle.

The accident goes back to the afternoon of July 27th. It was at the intersection of North 7th Street and 8th Avenue in Rochelle. Officer Jakymiw was driving through there at the time, responding to domestic disturbance call.

The Rochelle Police Department asked the Ogle County Sheriff's Office to review the officer's actions. On Friday, Sheriff Greg Beitel says the strongest information supporting the officer is six witnesses. They were at the intersection and saw the Jakymiw's squad approach with lights and sirens activated.

"It's a terrible situation. I'm sure the Rochelle Police officer feels bad about what happened. But we had credible witnesses who consistently told us the same things: the lights were on, the the sirens were on," Sheriff Beitel said.

The report also included some information from a black box in the officer's vehicle.

It showed his car reaching a peak speed of 62 miles per hour, then slowing to 48 and finally 17 miles per hour when he slammed on the breaks before the accident. Sheriff Beitel couldn't comment on whether those were excessive speeds.

Officer Jakymiw suffered head and hand injuries from the accident. He remains on leave recovering and should be back at work in about a month.
