The wrongful death lawsuit filed today on behalf of Eric Kumpf's family accuses the managers of constructing the porch in violation of city codes. It also accuses Chicago of failing to ensure that the porch was properly inspected.
A spokeswoman for the city's law department says the city wouldn't comment until it had seen the lawsuit. An attorney for landlord Philip Pappas did not immediately return a call seeking comment.
Kumpf was from Hoboken, New Jersey, and had been in town on business. His attorney says he was standing on the second floor porch at the weekend party when he was crushed.
