Pledge of Allegiance

The Pledge of Allegiance ruling is officially on hold.

The judge who declared it unconstitutional has issued a stay of his own ruling. It could be an indication that the full 9th U.S. Circuit Court of Appeals will review the ruling by its three-judge panel.

In Washington, the Justice Department says it will ask the full court for a reversal of the ruling. Judge Alfred Goodwin wrote in Thursday’s opinion that the phrase "under god" violates the separation of church and state.

The 9th District Federal Court in San Francisco is well-known for its irrational and radical decisions. Martin Quirk is a history professor and he says this will impact public views.

Even if Judge Goodwin had not issued the stay, the ruling wouldn't have taken effect for another 45 days, had it survived another judicial test.
