An arbitrator has ruled the county didn't have proper cause to fire Dana Fichtner, but could have disciplined him. Fichtner is eligible for back pay and benefits.
The arbitrator determined the county didn't have sufficient evidence to show Fichtner accessed anything other than a poker site on the Internet. Fichtner says the pornography was unwanted pop-up ads linked to the poker site.
Deputy corporation counsel Jerry Long says the county doesn't think accessing the porn was accidental, but likely won't appeal.
Fichtner was one of three jailers fired after the county started an investigation of Internet use by sheriff's department employees in 2003. Ten others were reprimanded.
