UPDATE: Lamont Cole has been sentenced to spend 165 years in prison for the 2011 shooting death of Charles Spivey.
Cole was sentenced for two counts of First Degree Murder, four counts of Attempt First Degree Murder, Mob Action, and Unlawful Possession of a Firearm by a Felon.
Police think Antwan Maxey was involved too, but murder charges were dropped last year when prosecutors missed their deadline. However, Maxey is in prison after he was sentenced to three and a half years this week for running from police. That gives prosecutors time to develop a new case.
The sentencing range for Murder is 35-75 years in the Illinois Department of Corrections.
The sentencing range for Attempt First Degree Murder is 21-45 years in the Illinois Department of Corrections and 2-10 years for Unlawful Possession of a Weapon by a Felon and 1 to 6 years for Mob Action. The Murder and Attempt Murder are all consecutive sentencing to each other.
Count 1 & 3 - First Degree Murder 50 years concurrent (100% to be served)
Counts 4 thru 7 - Attempt First Degree Murder 25 years per count consecutive to each other and to First Degree Murder
Count 12 – Aggravated Discharge of a Firearm 15 years consecutive to Attempt Murder charges and First Degree Murder. Attempt Murder and Aggravated Discharge of a Firearm (85% to be served)
Count 19 – Unlawful Possession of a Firearm by Felon 14 years (50% to be served)
Count 23 – Mob Action 6 years (50% to be served). Count 19 & 23 are both concurrent to all other charges
UPDATE: Lamont Cole has been found guilty of first degree murder. He was allegedly one of three men involved in a deadly shoot-out at a house party in January. It ended when 25-year-old Charles Spivey was shot in the head. You may recall Antwan Maxey was also supposed to stand trial, but charges were dropped when prosecutors didn't bring a case against him quickly enough.
